THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Who We Are and Our Legal Duties

This Notice of Privacy Practices applies to Thrive Services (referred to as “We,” “Our,” or “The Practice”) and our entire workforce, including all Direct Support Professionals (DSPs), Job Coaches, Administrative Staff, and other employees.

We are required by law to:

Maintain the privacy of your Protected Health Information (PHI).

Provide you with this Notice detailing our legal duties and privacy practices.

Notify you following a breach of your unsecured PHI.

Follow the terms of the Notice currently in effect.

Your Health Information Rights

You have the following rights regarding the PHI we maintain about you:

Right to Inspect and Copy: You have the right to inspect and obtain a copy of your PHI that is contained in a designated record set for as long as we maintain the PHI. We may charge a reasonable, cost-based fee for the labor and supplies of copying.

Right to Amend: If you feel that PHI we have about you is incorrect or incomplete, you may ask us to amend the information. We may deny your request, but we will provide you with a written explanation of the denial and how you can disagree with it.

Right to an Accounting of Disclosures: You have the right to request a list of certain disclosures we have made of your PHI for purposes other than treatment, payment, and health care operations.

Right to Request Restrictions: You have the right to request a restriction or limitation on the PHI we use or disclose about you for treatment, payment, or health care operations. We are not required to agree to your request, except we must agree to a request to restrict disclosure to a health plan if the disclosure is for the purpose of carrying out payment or health care operations and pertains solely to a healthcare item or service for which you or a person on your behalf has paid us in full out-of-pocket.

Right to Request Confidential Communications: You have the right to request that we communicate with you about medical matters in a certain way or at a certain location. For example, you can ask that we only contact you at work or by mail.

Right to a Paper Copy of This Notice: You have the right to a paper copy of this Notice at any time, even if you have agreed to receive this Notice electronically.

How We May Use and Disclose Your PHI

We may use and disclose your PHI without your authorization for the following reasons:

Treatment

We use your PHI to provide, coordinate, and manage your health care and related services. Example: We may disclose your PHI to a physician to whom you have been referred to ensure they have the necessary information for your care.

Payment

We use and disclose your PHI to bill and collect payment for the services we provide. Example: We may share PHI with your health plan or a third-party payer to determine eligibility for coverage or to obtain payment for your visit.

Health Care Operations

We use and disclose your PHI for our own operational purposes necessary to run The Practice and support high-quality care. Example: We may use PHI to review the quality of treatment and services we provide, or for business planning and management activities.

Business Associates

We may share your PHI with third-party service providers (called Business Associates) who perform functions on our behalf. We require all Business Associates to safeguard your information through a written agreement.

Other Permitted Uses and Disclosures

We are permitted or required by law to make other uses and disclosures of your PHI without your authorization, which include:

When Required By Law: When required by federal, state, or local law for audits, investigations, inspections, and licensure necessary for the government to oversee the health care system.

Judicial and Administrative Proceedings: In response to an order of a court or administrative tribunal, or in certain cases, in response to a subpoena or discovery request, as long as appropriate safeguards are met.

Public Health Activities: To prevent or control disease, injury, or disability, or for the purpose of public health surveillance, investigations, or interventions.

Law Enforcement: To law enforcement officials as required by law (e.g., to identify or locate a suspect, or to comply with a court order).

Research: When the use and disclosure has been approved by an Institutional Review Board (IRB) or Privacy Board that has reviewed the research proposal and established protocols to ensure the privacy of your PHI.

Avert a Serious Threat to Health or Safety: When necessary to prevent a serious and imminent threat to the health or safety of you, the public, or another person.

Workers’ Compensation: To comply with laws relating to workers’ compensation or similar programs.

Uses and Disclosures Requiring Your Written Authorization

We will not use or disclose your PHI for any purpose not covered by this Notice without your written Authorization. This includes:

Marketing: Most uses and disclosures for marketing purposes.

Sale of PHI: Most disclosures that constitute a sale of PHI.

Psychotherapy Notes: Most uses and disclosures of psychotherapy notes (if maintained).

You have the right to revoke an Authorization at any time, in writing, except to the extent that we have already acted in reliance on the Authorization.

Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

Embedded content from other websites

Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.

Who we share your data with

If you request a password reset through our website, your IP address will be included in the reset email. Your contact information will not be shared with third parties for promotional or marketing purposes.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

Thrive Services SMS/Text Messaging Terms of Use

By “Opting In” to or using a “Text Message Service” (as defined below) from Thrive Services LLC, you accept these Terms & Conditions.

This agreement is between you and Thrive Services LLC or one of its affiliates. All references to “Thrive Services,” “we,” “our,” or “us” refer to Thrive Services LLC, located at 9660 W State St, Star, ID 83669.

DEFINITIONS

“Opting In,” “Opt In,” and “Opt-In” refer to requesting, joining, agreeing to, enrolling in, signing up for, acknowledging, responding to, or otherwise consenting to receive one or more text messages.

“Text Message Service” includes any arrangement or situation in which we send one or more messages addressed to your mobile phone number, including text messages (such as SMS, MMS, or successor protocols or technologies).

CONSENTING TO TEXT MESSAGING

By consenting to receive text messages from us, you agreed to these Text Messaging Terms and Conditions, as well as our Privacy Policy, incorporated herein by reference.

E-SIGN DISCLOSURE

By agreeing to receive text messages, you also consent to the use of an electronic record to document your agreement. You may withdraw your consent to the use of the electronic record by replying STOP.

THRIVE SERVICES TEXT MESSAGE SERVICE PRIVACY POLICY

We respect your privacy. We only use information you provide through this service to transmit your mobile messages and respond to you. This includes, but isn’t limited to, sharing information with platform providers, phone companies, and other vendors who assist us in the delivery of mobile messages. Mobile information will not be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. Nonetheless, we reserve the right always to disclose any information as necessary to satisfy any law, regulation or governmental request, to avoid liability, or to protect our rights or property. This Text Message Service Privacy Policy applies to your use of the Text Message Service and isn’t intended to modify our general Privacy Policy, incorporated by reference above, which may govern the relationship between you and us in other contexts.

COSTS OF TEXT MESSAGES

We do not charge you for the messages you send and receive via this text message service. But message and data rates may apply, so depending on your plan with your wireless or other applicable provider, you may be charged by your carrier or other applicable provider.

FREQUENCY OF TEXT MESSAGES

This Text Messaging Service is for conversational person-to-person communication between you and our employees. We may send you an initial message providing details about the service. After that, the number of text messages you receive will vary depending on how you use our services and whether you take steps to generate more text messages from us (such as by sending a HELP request).

OPTING OUT OF TEXT MESSAGES

If you no longer want to receive text messages, you may reply to any text message with STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE. As a person-to-person communication service, opt-out requests are specific to each conversation between you and one of our employees and their associated phone number. After unsubscribing, we may send you confirmation of your opt-out via text message.
